Pesticide intellectual property protection needs to be strengthened

With the implementation of the Patent Law, the number of patents for pesticides in China has grown rapidly. In 2008, the number of applications for pesticide invention patents has exceeded 1,800, which is more than nine times the number of applications filed in 1985. However, the ensuing infringement is also becoming increasingly serious. Therefore, it is necessary to increase the protection of pesticide intellectual property.

In recent years, enterprises, universities and research institutes in the pesticide field in our country have been plagued by frequent infringements. For example, Zhejiang Xin'an Chemical is the world's second-largest producer of glyphosate, second only to Monsanto. The patented technology for the recovery of glyphosate, a by-product of glyphosate, was stolen by many domestic manufacturers. Although Xinan Chemical sued other companies for infringement cases and eventually won the lawsuit, it still failed to stop the infringement of many companies.

At present, the means of technology infringement can be described as varied. Some of them buy patents to own the technical personnel of the company; some assign employees to the other company's enterprises to hire stealing technology; some even impersonate the other worker, forge documents, and directly enter the other party's production workshop. Professor Yin Yingwu of Tsinghua University entered the field of pesticide technology research and development as early as in 1995. There have been more than 80 patents applied for and authorized, of which pesticides and related patents account for 1/3. They have been repeatedly infringed during the commercialization of patented technologies.

China is a big country in the world of pesticides, and it is not yet a powerful country in pesticides. In order to protect the interests of innovators, I propose to formulate scientific and reasonable laws and regulations on pesticides, strengthen implementation, reduce the cases of pesticide patent infringement and the production and sale of fake and shoddy products from the source; formulate correct pesticide industry policies and earnestly We must implement the implementation and avoid orders; we must implement the prohibition of the same industry and protect the intellectual property rights of enterprises; severely punish the infringements, publicize the “black list”, and let the infringers like “cross-strait mice” and everyone shout.
